West Virginia's governor Patrick Morrisey and legislative leaders unveiled a seven-point plan at a press conference on August eleventh — about three weeks before this episode, with the state's Department of Commerce having released the seven principles a few days earlier — and it's genuinely bold on paper: take half of the revenue from approved hyperscale data center projects and use it to shrink, then eventually eliminate, the state's personal income tax. Under the plan, host counties would get thirty percent of a project's revenue for schools and local government, another ten percent gets split across all fifty-five counties, and a final ten percent funds water and electrical infrastructure upgrades. Now, that infrastructure slice looks aimed squarely at Tucker County, where residents have fought Fundamental Data LLC's proposed hyperscale project even as state regulators let it move forward. Morrisey's pitch is straightforward — he wants West Virginia to catch the investment fleeing Virginia's own stalled fight over its data center tax breaks. Tucker County opponents, per West Virginia Watch's reporting, see it differently: they argue the project brings no tangible benefit to the people actually living next to it, while the costs land on them. So how does a state actually get from a seven-point proposal to a real budget line? Nobody's published that yet — how much hyperscale investment is actually signed under this framework, versus just proposed, is still an open question.
In Oakland, developer Colin Behring wants to put a data center inside a former Lawrence Berkeley National Lab supercomputer building downtown, and it's split the city. Councilmember Carroll Fife appeared publicly alongside Behring to argue this is a small, single-floor IT installation, not a sprawling hyperscale campus like the gigawatt-scale sites going up elsewhere. The opposition group No Data Centers in Oakland, along with the Party for Socialism and Liberation, has organized petitions over energy, water, and pollution concerns. Now, the process complaint here is separate from the size complaint, and it's the sharper one: the project got approved ministerially, meaning it cleared under forty-five-year-old industrial zoning instead of going through a full public hearing. Behring calls the IT floor 'minuscule' next to bigger campuses and says 'misinformation has fueled some of the backlash.' It lands, though, in a place already primed for this fight — residents near Piedmont have spent months raising water-strain and noise concerns over Cloverleaf Infrastructure's proposed data center near the Mathewson Substation, one of Oklahoma's strongest grid interconnection points. Next door in Luther, the pushback got organized enough that the town passed its own six-month development moratorium back in June. If this footage does check out, it's the community's worst fear about the site-selection math said out loud: pick the town for the wires and gas lines already there, not for whether the neighbors want you.
On the other side of that same tension, trade unions are making noise. Analyst @PatrickMoorhead posted on X a claim that unions are threatening to withhold support from politicians who oppose data center construction, citing blue-collar construction jobs at stake — he also argued that 'bogus' water and power numbers used against these projects deserve to be called out. The underlying union statement isn't independently sourced beyond posts relaying it, so which unions and which candidates are actually named stays unconfirmed. But the amplification stacked up fast: @Polymarket posted on X, 'JUST IN: Trade unions threaten to withhold political support from candidates opposing data centers, warning thousands of blue-collar jobs could be lost.' Energy communications consultant @saeverley wrote on X that banning data centers 'may quickly become a political loser.' Whichever statement started this, the reaction tells you something real — the jobs argument is getting as loud as the water and noise arguments in these fights.
Our main story today: the AI data center that's been quietly running dirty for the deal everyone points to as proof this buildout is real. Picture the machine first, then the number. A gas power plant, sixty-two individual generator units, sitting about a mile from two schools in Vineland, New Jersey — and according to a joint investigation from Floodlight and The Guardian, using thermal drone footage, at least forty-five of those sixty-two units have been running without a single permit. Now here's what that plant actually powers: a seventeen-billion-dollar AI computing agreement between Microsoft and the cloud company Nebius. Seventeen billion dollars of contracted compute, running partly on gas generators nobody signed off on. This isn't DataOne's first run-in with local authorities either — the city of Vineland has repeatedly hit the facility with stop-work orders, and residents have also filed a lawsuit over nighttime noise. And this is where the federal angle sharpens: Bruce Buckheit, who used to run air enforcement at the EPA, told Floodlight that a facility running unpermitted generators at this scale is likely violating federal law, and that DataOne should be facing fines for the emissions it's putting into the air a mile from two schools. For anyone new to this, a permit here isn't paperwork for paperwork's sake — it's the mechanism that caps how much pollution a facility is legally allowed to emit, reviewed against exactly what's nearby, in this case kids in two schools within a mile. Running forty-five generators outside that review means nobody's checked whether the emissions fall within any limit at all. New Jersey's Department of Environmental Protection hasn't announced an enforcement action yet, and what a penalty would even look like for a facility feeding a seventeen-billion-dollar contract is a question the state hasn't answered.

Nobody in this story — not the city, not the state, not DataOne — has answered that on the record. Now, my read, and I'll label it as mine: when a company's response to a specific, numbered allegation is a single sentence about being 'committed to meeting all applicable and environmental and permitting requirements,' that's usually not a rebuttal, it's a placeholder while the lawyers figure out how big the exposure is. DataOne didn't dispute the count of forty-five. It didn't dispute Buckheit's read on federal law. It restated a general intention and left it there. And then there's Microsoft and Nebius, saying nothing at all. I want to be fair here — silence isn't an admission, and maybe they're doing their own diligence before commenting. But this is exactly the situation where I'd apply my own standard, and I'll own it as mine: a company spending at Microsoft's scale on AI infrastructure can afford a real, on-the-record answer about whether the facility running its seventeen-billion-dollar deal is polluting a New Jersey town without permits. Silence is a choice too. Here's what would make this credible in the other direction: a New Jersey DEP enforcement filing, with an actual penalty attached, that either confirms or corrects the forty-five-generator number. That document turns this from drone-footage allegation into settled fact. Until it shows up, this sits exactly where the reporting left it — one side's specific numbers against the other side's silence. And there's the question this show keeps asking about every one of these builds: what does Vineland actually get for hosting this? The reporting doesn't show a community benefits package, doesn't show what tax revenue looks like, doesn't show promised jobs beyond construction. What it shows is stop-work orders, a noise lawsuit, and now a federal air-quality question hanging over a facility a mile from two schools.
